Updated: Former Middleton Resident Charged in Sexual Assault Case

MADISON – A Mount Horeb man was formally charged Tuesday with four child sex offenses and ordered released from jail on a signature bond with conditions.

Brian R. Henige, 53, formerly of Middleton, was arrested and jailed Saturday after police investigated a tip that Henige had been sexually assaulting a 15-year-old female and showing her pornography during the past several months.

Assistant District Attorney John Black asked for a $10,000 cash bail saying the allegations against Henige are “extremely serious” and occurred up until a week ago.

“There were more incidents reported than what was charged. According to the victim, the defendant told her that he would kill her and they would never find her body if she reported what happened,” Black told Court Commissioner Daniel Floeter.

Black called Henige a flight risk and said a cash bond is necessary to ensure his appearance at future court proceedings.

Henige’s attorney, Paisley Hoffman, opposed cash bond for her client saying he had never been convicted or even charged with a crime, has strong ties to the community, including a seven or eight-year-old son, and he should be presumed innocent at this time.

Hoffman also opposed Black’s request for no unsupervised contact with minors, saying Henige is married and is working out arrangements with his wife on any contact with his son.

Black replied that the no unsupervised contact bail provision was requested by Henige’s wife.

Floeter decided that only a signature bond was required for Henige’s release on conditions noting his lack of prior arrests or convictions, ties to the community and retaining an attorney.

“That shows he intends to stick around and contest the charges,” he said.

Other bond conditions imposed including no contact with the alleged minor victim and a ban on being on North or Maywood Avenues in Middleton.

Henige is closing on the sale of his house in the North and Maywood Avenues area but doesn’t need to be in there since the home has largely been emptied, Hoffman said.

Henige has been charged with Second-Degree Sexual Assault with a modifier of the crime occurring in the vicinity of a school zone. Also, two counts of Exposing Genitals to a Child and a single count of Exposing a Child to Harmful Materials.

If convicted on all charges, Henige would face a maximum penalty of 51 years in prison.

Hoffman waived the time limits on holding a preliminary hearing and no further court dates were set.

MIDDLETON–A Mount Horeb man is in custody after police say he sexually assaulted and showed pornographic images to a 15-year-old.

Brian R. Henige, 53, was arrested by Middleton detectives in the 7600 block of Maywood Avenue on March 6. Police received information about the alleged crime on March 4, and further investigation and collection of evidence led to the arrest two days later.

Police say Henige, a former Middleton resident, and the victim knew one another. The allegations range over an eight month time frame.

Henige was booked into Dane County Jail on charges of Sexual Assault of a Child, Repeated Acts of Sexual Assault of the Same Child, and Exposing a Child to Harmful Material.  The investigation into this incident is ongoing.
